 Questions for the Open Meeting on Apr. 27, 2021


The following questions were submitted via QCC.  Hopefully they will be addressed at the meeting on the 27th. 

1 Will we have access to the waterfront next season - 2022?  If yes, how are we going to get the elevator/stairs repaired? What are we going to do differently to make sure it gets done? When do you expect the repairs to be finished?


2 What litigation are we currently involved in? Please provide the following information on the homeowner section only on our website.

Who is representing BHVA?

What insurance company is covering the case for BHVA?

How much have we spent in legal fees to date?


3 There was a line item on the 2019 budget for $250,000 for elevator repairs - we've spent $60,000 for repair parts but there is no line item for $190,000  on the 2020 budget. Has the money been spent or is it in reserve fund? 


4 Is the BOD trying to shut down the kayak business on the waterfront? If yes, where will residents store their kayaks?


5 Several communications from the 4 presidents have been distributed via Constant Contact under BHVA letterhead.  Can another community group have information of interest to the community distributed to the BHVA community using the BHVA Constant Contact distribution?  


6 How many residents have not paid the first and second special assessment for legal fees ($800)?

Have liens been placed on the property of those in arrears?

Can this money be used for anything other than legal fees?


7 Has the $108,000 legal fee been paid for the 3B’s suit?  Can we see the itemized charges for the $108,000? Why was it so much?


8 Can we see a copy of the Insurance Certificate with Erie Insurance?


9 Are we still pursuing the appeal for recovering the $108,000 in the 3B’s case?  What’s the chance of winning the appeal?  How long will this take?
